Term Of Use

1. You agree to pay the premium and/or other monies payable to the Insurance Agent for your acquisition of cargo insurance by credit card or via the account you currently maintain with Tradelink (the “Account”). For payment via the Account, you hereby authorize Tradelink to debit the Account to pay the same to the Insurance Agent for and on behalf of you.

2. In the case of a failed insurance application due to unavailability of the Account or insufficient funds or whatever causes, you agree that Tradelink shall not be held liable for such failure and any damage or loss arising therefrom or in connection therewith.

3. You acknowledge and agree that the Service at each time of your use shall end at a cargo cover note being made available for download online in respect of your application, and further that matters following the cargo cover note shall be dealt with between you and the Insurance Agent, and Tradelink shall have no responsibility in respect of such matters.

4. You agree that Tradelink may suspend or terminate the Service or the credit card payment arrangement at any time without notice, in which case Tradelink shall not be held liable for any damage and loss that you would sustain due to or in connection with such suspension or termination.

5. You warrant that the use of the Service shall be confined to the Authorized Message Authorizer(s ) so authorized by you for the Service. In the case of a login password and/or a key is generated by Tradelink to enable you to use the Service, you undertake to keep the same in safe custody from use by any person without your proper authorization. Tradelink shall in no event be held liable for any damage or loss arising from or in connection with any unauthorized use of the Service.

6. You acknowledge and agree that Tradelink may, from time to time, revise the provisions hereof at its sole discretion and your continued use of the Service shall be governed by the revised version.

7. You acknowledge and agree that Tradelink reserves its absolute right to charge for the use of the Service and/or the credit card payment method provided herein at any time subject to a one-month advance notice posted on its corporate website accessible at www.tradelink.com.hk .

8. With regard to the information and personal data that you may provide herein, Tradelink will use the same for direct marketing to your company of the services or goods of Tradelink or its subsidiaries and business partners from time to time.

Disclaimers

1. You acknowledge that Tradelink is neither an insurance agent/broker nor a subsidiary/holding company/subsidiary of the holding company of the Insurance Agent.

2. You acknowledge and agree that your acquisition of cargo insurance from the Insurance Agent, albeit by using the Service, is a transaction between you and the Insurance Agent only whereas Tradelink is not a party thereto. You agree that Tradelink shall bear no liability for any transaction that you may enter into with the Insurance Agent by using the Service.

3. Tradelink makes no warranty that access to or use of the Service, this site or the server which makes the Service available will be uninterrupted, error-free.

4. Tradelink shall not be responsible for any virus infections, contaminations, delay in operation or transmission, line failure, errors, omissions, interruptions or defects arising out of your use of the Service or with respect to the material provided or contained in this site. IN NO EVENT SHALL TRADELINK BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL DAMAGES OR OTHER DAMAGES OF ANY KIND, RESULTING FROM WHATEVER CAUSE, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA OR LOSS OF BUSINESS OPPORTUNITY.

You acknowledge that quotations for the cargo insurance and terms of offer (if any) shall be provided by the Insurance Agent and shall in no event be construed as advice of Tradelink on insurance products. TRADELINK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
